ARTICLE 2- SUBJECT 

The subject of this agreement is the sale and delivery of the product, which the BUYER ordered electronically from MAYA BOUTIQUE website and the qualifications and sales price of which are specified below, and to define the rights and obligations of the parties in accordance with the provisions of the Consumer Protection Law no 4077 and the Regulation On Implementing Principles and Procedures of Distant Agreements.

ARTICLE 4- GENERAL PROVISIONS
 

4.1- The BUYER declares that he/she read and had preliminary information about the essential features, sales price, payment method, and delivery of the product in the MAYA İBRAHİM AVNİ KIRKANAHTAR website and he/she has given his/her required consent in electronic environment.

4.2- The contract product is delivered to the BUYER or person/institution in the address designated by him/her within the period mentioned within the preliminary information for each product in the website, depending on the distance of the residential address of the BUYER, provided that it doesn’t exceed the 3-day legal period.

4.3- If the contract product will be delivered to another person/institution else than the BUYER, the SELLER shall not be held responsible for the non-acceptance of the person/institution of the delivery.

4.4- For the delivery of the contract product, it is required that the signed copy of this agreement is transmitted to the SELLER, and the fee is paid by way of the payment method preferred by the BUYER. For any reason whatsoever, if the product fee is not paid or canceled in bank records, the SELLER is deemed to have been discharged from the delivery obligation of the product.

4.5- If the SELLER may not deliver the product within the designated period due to exceptional circumstances such as the force majeure events or adverse weather conditions preventing the shipment, and discontinuation of transportation, it has to notify the situation to the BUYER. In that case, the BUYER may use of his/her following rights: canceling the order, and/or replacing it with an equivalent product, and/or postponing it until the impending condition is removed. In case the BUYER cancels the order, the paid amount is refunded to him/her in cash at once within 10 days.
